Terms of Use

Mercare Markets is an online marketplace that connects buyers of raw materials and commodities with suppliers. Buyers publish requests for quotation ("RFQs"), suppliers submit quotations, and buyers may award a supplier of their choice. Mercare Markets acts solely as a venue; we are not a party to any contract formed between a buyer and a supplier.

You must register for an account to publish RFQs or submit quotations. You may register as a buyer or as a supplier. You agree to provide accurate company and contact information and to keep your credentials confidential. You are responsible for all activity under your account.

An RFQ is an invitation to treat, not a binding offer to purchase. A quotation is an offer made by a supplier to the buyer who published the RFQ. A binding contract is formed only when a buyer accepts a quotation, and that contract is solely between the buyer and the supplier. Buyers may choose to publish RFQs anonymously; anonymity does not change the legal nature of the RFQ.

Prices, quantities, specifications, delivery terms, and any other commercial terms are set by buyers and suppliers. Suppliers may quote in a currency of their choice; any currency conversion shown on the platform is indicative only, based on third-party exchange rates, and does not constitute the agreed contract price.

Mercare Markets does not verify the identity, creditworthiness, licensing, or reliability of any buyer or supplier, and does not guarantee the quality, legality, or availability of any commodity, the performance of any contract, or that any RFQ will receive quotations. You are solely responsible for conducting your own due diligence before entering into any transaction.

You agree not to:

• Post false, misleading, or fraudulent RFQs or quotations.
• Impersonate another person or company, or misrepresent your affiliation.
• Use the platform for any unlawful purpose, including trading sanctioned goods.
• Scrape, harvest, or misuse data belonging to other users.
• Attempt to circumvent anonymity features or disclose another user's confidential information.
• Interfere with the operation or security of the platform.

We may suspend or terminate accounts that violate these terms.

Quotations, including supplier pricing and contact details, are visible only to the buyer who published the RFQ and the supplier who submitted the quotation. You agree not to disclose commercial terms shared with you through the platform to third parties without the consent of the other party.

The platform, its design, and its content (excluding user-submitted content) are owned by Mercare Markets. You retain ownership of the content you submit, and grant us a licence to display it on the platform as necessary to provide the service.

The platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Mercare Markets is not liable for any indirect, incidental, or consequential damages, or for any loss arising from transactions between users, including loss of profits, loss of goods, or payment disputes. Our aggregate liability is limited to the fees (if any) you paid to us in the twelve months preceding the claim.

We may update these terms from time to time. Continued use of the platform after a change takes effect constitutes acceptance of the revised terms.
